A woman in her thirties has been incarcerated following allegations that she falsely accused her father of rape, reportedly due to monetary disputes, despite his financial support for her overseas education.

On the 1st, the judicial community reported that the Namyangju Branch of the Uijeongbu District Court's Criminal Division 1, under the chairmanship of Judge Choi Chi-bong, sentenced a woman, known as A, to a 10-month prison term. She was convicted on charges including defamation, business obstruction, and insult.

Between May and June of the previous year, A faced legal proceedings for allegedly making 11 defamatory posts on an online platform, under the heading "I am a victim of familial sexual violence. Please look at this," targeting her biological father, B.

Within these online posts, she incorrectly asserted, "I have been subjected to ongoing sexual abuse by my biological father since the age of four, and my mother has also endured domestic and sexual violence," adding that "The matter was settled with 30 million won in damages," and advocating for "Severe punishment."

During this period, A disclosed B's identity and business details, reportedly causing operational challenges for B's business.

Furthermore, A made six additional posts alleging that B had remarried a woman, identified as C, with whom he had allegedly had an extramarital relationship.

In February 2021, A initiated a damages lawsuit against B at the Incheon District Court for alleged sexual assaults but failed to substantiate any illegal conduct.

In criminal court, A maintained that her assertions were truthful, yet the court, referencing the lawsuit's outcome, rejected her statements, noting the absence of concrete evidence or circumstances supporting habitual sexual abuse claims against B.

The court surmised that A's accusations were false, considering the financial assistance she received from B during her education abroad and after her return, alongside her timing of the rape allegation following B's refusal to fund a café venture.

The court highlighted, "A disseminated false information about the victims due to dissatisfaction over financial support denial. The reputations of the victims are irrevocably tarnished."

Elaborating on the sentencing rationale, the court noted, "The likelihood of reoffending remains high as A persists in similar conduct post-crime. The victims' strong demand for stringent punishment was a significant consideration."
